Terms and Conditions – Byron Bay Airport Transfers 2023 Pty Ltd trading as The Other Way
1. Agreement and Acceptance
By engaging the services of The Byron Bay Airport Transfers 2023 Pty Ltd trading as The Other Way, hereinafter referred to as “the Company,” you agree to the following terms and conditions. These terms constitute a legal agreement between you, hereinafter referred to as “the Customer,” and the Company. Please read these terms carefully before using our transportation services. If you do not agree with any part of these terms, you may not use our services.
2. Transportation Services
The Company specializes in providing transportation services to and from airports in Byron Bay, NSW. Our services include airport transfers, pick-ups, and drop-offs.
3. Booking and Reservations
Customers are required to make a reservation for transportation services in advance. Reservations can be made online, via phone, or through an authorized agent. To confirm a reservation, the Customer must provide accurate information, including the date and time of travel, flight details, passenger count, and any special requirements.
4. Pricing and Payment
The pricing for transportation services will be communicated to the Customer during the reservation process. Prices may vary depending on factors such as distance, vehicle type, and additional services requested. Payment must be made in full at the time of booking unless otherwise agreed upon. The Company accepts various forms of payment, including cash, credit cards, and electronic transfers.
5. Cancellation and Refunds
a. Cancellation by the Customer:
If you need to cancel or amend your booking you need to do so by 5pm the day before. Any cancellations after this time will result in you being charged the full amount as a cancellation fee.
Failure to provide timely notice may result in a cancellation fee.
b. Cancellation by the Company: The Company reserves the right to cancel a reservation due to unforeseen circumstances, including but not limited to vehicle unavailability or force majeure events. In such cases, the Customer will receive a full refund or an alternative transportation arrangement.
6. Liability and Responsibility
a. The Company shall not be held responsible for any delays, inconveniences, or losses caused by circumstances beyond its control, including traffic congestion, road closures, or flight delays.
b. The Customer is responsible for ensuring that all the provided information, including flight details and pick-up addresses, is accurate. The Company shall not be liable for any losses or additional costs incurred due to inaccurate information provided by the Customer.
c. The Company shall not be liable for any loss, damage, or theft of personal belongings or baggage during transportation. Customers are advised to take necessary precautions to safeguard their belongings.
7. Safety and Conduct
a. The Customer is expected to behave in a respectful and courteous manner towards the Company’s staff and other passengers.
b. The Customer shall comply with all applicable laws, regulations, and airport rules during the transportation service.
c. The Company reserves the right to refuse service or terminate transportation in the event of unruly behavior, intoxication, or any other action that may jeopardize the safety and comfort of the driver or other passengers.
8. Privacy and Data Protection
The Company respects the privacy of its customers and handles personal data in accordance with applicable privacy laws. The Customer’s personal information will be used solely for the purpose of providing transportation services and will not be shared with third parties without consent, except as required by law.
9. Amendments and Modifications
The Company reserves the right to amend or modify these terms and conditions at any time. Any changes will be effective immediately upon posting on the Company’s website or notifying the Customer through other appropriate channels.
10. Governing Law and Jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws of the state of New South Wales, Australia. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts in
Waiting time
A standby rate (waiting time) of $30 applies after a 20 minute grace period from the time of booking pick up time
After the first 20 minutes an additional fee applies at $1 per minute . A grace period of 30 minutes applies for International Flight Arrivals.
